Program Builder terms and conditions of use
Thank you for joining Program Builder for the NSW syllabuses, operated and maintained by the NSW Education Standards Authority (NESA). It is important you read these terms and conditions carefully. By using Program Builder, you are indicating that you agree to these terms and conditions. If you do not agree with the terms and conditions please do not use Program Builder.
To use the features of Program Builder you must be eligible for a Program Builder account. You must be 18 years old or over and a K–12 educator or pre-service teacher in New South Wales to be eligible for a Program Builder account.
If you are eligible for a Program Builder account and have a NSW Department of Education (DOE) account or CeNet account, your Program Builder account is already activated and ready to use with either your DOE or CeNet login details.
For all other Program Builder users, NESA uses a third party authentication service, Auth0 to verify Program Builder account users. Your encrypted details (school email address, name, role and teaching level) will be stored on Auth0’s secure servers, located in Australia. You are responsible for keeping your login details confidential and secure.
You agree to and need to abide by, the Program Builder terms and conditions of use as outlined on this page. You agree not to use Program Builder for any illegal or unauthorised purpose. You must also use your login details in accordance with the DOE or NESA terms and conditions of use. Please contact the DOE, CeNet or NESA if you have any issues with your login details.
Your Program Builder account is non-transferable and we may terminate your account if you are found in breach of these terms and conditions of use.
NESA is collecting your personal information in accordance with the Privacy and Personal Information Protection Act 1998 (NSW) so that we can provide targeted information regarding Program Builder maintenance, updates, redevelopment and testing. We may also contact you in relation to user feedback and testing on the development of other NESA products.
Your personal information will only be accessed by authorised staff of NESA for the purposes outlined above. NESA will not disclose the information to any other person or agency unless required or permitted by law.
Providing your personal information is voluntary. However, if you do not provide the information, you will be unable to use Program Builder.
Program Builder contains content from the NSW syllabuses prepared by NSW Education Standards Authority (NESA) for and on behalf of the Crown in right of the State of New South Wales. The NSW syllabus material is protected by Crown copyright. All rights are reserved. No part of the NSW syllabuses or support materials may be reproduced in Australia or in any other country by any process, electronic or otherwise, in any material form or transmitted to any other person or stored electronically in any form without the prior written permission of NESA, except as permitted by the Copyright Act 1968 (Cth).
NESA grants you the right to use the NESA NSW syllabuses and support materials in your own documents for classroom planning and to reproduce copies for personal bona fide non-commercial educational use only. It is your responsibility to ensure you have permission to use any third-party copyright material in your use of Program Builder.
The NESA syllabuses, support materials, and Program Builder cannot be used for commercial purposes without explicit written permission from NESA’s Copyright Officer, who can be contacted on (02) 9367 8289 or by fax on (02) 9279 1482.
Content created by you
NESA does not claim any ownership of the programs, including scope and sequences and units, you create in your Program Builder account, nor is it in a position to access, re-use or sub-licence the content you create without your permission.
The copyright in content you create in Program Builder for use in your job may belong to your employer unless there is an agreement between you and your employer regarding the ownership of copyright. If you are unsure about the status of the copyright, contact your employer to discuss the ownership, especially as the content may NOT be transferable if you change employment.
NESA retains all rights in the original contents of the NSW syllabuses and support materials.
Service and security
It is your responsibility to back up any content you produce in your Program Builder account by regularly exporting it. NESA is not responsible for any loss of content.
NESA intends for Program Builder to be available as much as possible, however there will be occasions where your account may be unavailable due to scheduled maintenance or upgrades, emergency repairs, or failed connectivity links/equipment.
NESA may amend and update the Program Builder terms and conditions of which you will be notified via the site when logging in and/or by email. Continued use of your account at this point will be taken as confirmation that you agree to the amended terms and conditions
